- Last Will and Testament of Timothy Chapman Deceased. 2098
Be it Remembered, That heretofore, to wit: on the 12th day of December in the year of our Lord one thousand eight hundred and fifty nine, Timothy Chapman, sole Executor named in the Last Will and Testament of Timothy Chapman late of the town of Lenox in the County of Madison and made application to have the said Last Will and Testament, which relates to both Real and Personal Estate, proved and on such application the said Surrogate did ascertain by satisfactory evidence who were the ____ heirs at law and next of kin of the said testator, and their respective residences, viz. Charlotte Chapman the widow, and Mehitable Bushnell, Electa A. Ely, Susan M. Evans, Harriet L. Hart and Timothy Chapman heirs & next of kin of said deceased and said Surrogate did thereupon issue a Citation in the form of law directed to the widow heirs at law and next of kin above named by their respective names, stating their respective places of residence, requiring them to appear before said Surrogate at his office in the village of Morrisville in said County on the 4th day of February A. D. 1860, to attend the Probate of said Will.
And afterward, to wit: on the 4th day of February A.D. 1860, satisfactory evidence by affidavit was produced to said Surrogate, of the due service of said Citation in the mode prescribed by law, and on that day, no one appearing to oppose the Probate of such Will such proceedings were thereupon had in said Court afterwards, that the said Surrogate took the proofs of said Will hereinafter set forth, upon this 4th day of February A. D. 1860 and the 18th day of February aforesaid to ________ and he thereupon adjudged the said Will to be a valid Will of Real and Personal Estate, and the proofs thereof to be sufficient, which said Last Will and Testament, and proofs are as follows, that is to say:
Know all men by these present that I Timothy Chapman of the town of Lenox in the County of Madison and State of New York, farmer, Considering the uncertainty of this life and being of sound mind & memory do make declare and publish this my last will and testament.
First I give & bequest to my beloved wife Charlott all my household goods to be at her disposal during her lifetime and what is not disposed of during her lifetime to go to my son Timothy.
Second I give & bequeath to my daughter Electa Ann Ely one hundred dollars to be paid her by my son Timothy. I give & bequeath to my daughter Mehitable Bushnell one hundred dollars to be paid by my son Timothy. I give and bequeath to my daughter Susan Mariah Evans on hundred dollars. And I give & bequeath to my grand daughter Harriet Lavinia Ely one hundred dollars and to my grand daughter Charlott Manerva Ely the sum of fifty dollars.
I give & bequeath to my son Timothy all the rest and residue of my personal & real estate after paying my debts and the aforesaid legacies and providing a comfortable support for my wifes sister Abigail Jones during her life.
And lastly I give & bequeath to my son Timothy after paying & providing as aforesaid and performing all things as above provided all the rest and residue of my my(sic) real estate and personal property that I may die seized of or to which I shall be entitled at the time of my decease to have and to hold the same to him his heirs Executors administrators and assigns forever.
I do nominate constitute and appoint my son Timothy Chapman Jun. to be the Executor of this my last will and testament.
In Witness whereof I have to this my last will and testament contained on one sheet of paper to which I have subscribed my name and affixed my seal this 21st day of February 1851
